GODISNJI IZVESTAJ ODBORA ZA LJUDSKA PRAVA U LESKOVCU O STANJU LJUDSKIH PRAVA NA TERITORIJI JABLANICKOG OKRUGA SA ASPEKTA DEKLARACIJE GENERALNE SKUPSTINE UN O LJUDSKIM PRAVIMA I RADU ODBORA NA AFIRMACIJI I ZASTITI TIH PRAVA U 2014 GODINI.

Tokom 2014.godine Odboru za ljudska prava u Leskovcu za pravnu pomoc I pravne savete obratila su se 3811 korisnika,od tog broja oko 3000 korisnika nasih usluga obratilo nam se licno,dolaskom u kancelariju Odbora dok se preostali broj korisnika javio telefonom,mejlom ili pismom.

Nacinalna struktura korisnika je najvecim delom srpske nacionalnosti,zatim romske,albanske I cetiri arapske nacionalnosti.

Pravne savete iz delatnosti Odbora pruzili smo za 2986 nasih korisnika.

Sa aspekta Deklaracije Generalne Skupstine Ujedinjenih Nacija korisnici koji su nam se obracali za pomoc je sledeca:

Cl.5 Deklaracije,zabrana mucenja,svirepog ili necovecnog ili ponizavajuceg postupanja ili kaznjavanja ljudi- 29 slucajeva

Cl.6 Deklaracije,pravo na pravni subjektivitet-355 slucajeva

Cl.7 Deklaracije,pravo na jednaku zastitu zakona bez diskriminacije-122 slucajeva

Cl. 8 Deklaracije, pravo na efikasnu sudsku zastitu od dela krsenja osnovnih prava priznatih Ustavom I zakonom-359 slucajeva

CL.9 Deklaracije,zabrana proizvoljnog hapsenja I pritvaranja-12 slucajeva

Cl.10 Deklaracije, pravo na pravicno sudjenje pred nezavisnim I nepristrasnim sudom-330 slucajeva

Cl.12 Deklaracije, zabrana proizvoljnog mesanja u privatni zivot, porodicu, stan, prepisku I napadima na cast I ugled-71 slucajeva

Cl.17 Deklaracije, pravo na imovinu I zabrana samovoljnog lisenja imovine- 105 slucajeva

  • Deklaracije, pravo na slobodu mirnog izbora I udruzivanja-5 slucajeva

  • Deklaracije, pravo na ucestvovanje u upravljanju u javnim poslovima I pravo svakoga da na ravnopravnoj osnovi stupa u javnu sluzbu u svojoj zemlji- 13 slucajeva

Cl.23 Deklaracije, pravo na rad I zadovoljavajuce uslove rada-1593 slucajeva

Cl.24 Deklaracije, pravo na odmor – 18 slucajeva

Cl.25 Deklaracije, pravo na zadovoljavajuci zivotni standard I pravo na stan- 463 slucajeva

Cl.26 Deklaracije, pravo na skolovanje- 5 slucajeva.

U izvestajnom periodu za potrebe korisnika nasih usluga napisali smo 133 tuzbe, 81 zalbu, 205 krivicne prijave, 156 Prituzbe po cl.34 Povelje o ljudskim I manjinskim pravima Republike Srbije I cl.48 Ustava Republike Srbije, na nerad I neefikasan rad sudova, 350 zahteva inspekciji rada, 155 podnesaka razne vrste, 61 predlog za ponavljanje prekrsajnih I krivicnih postupaka, 3 zahteva za sprovodjenje istrage, 16 predstavke Medjunarodnom sudu za ljudska prava u Strazburu.

U izvestajnom periodu nam se javio najveci broj korisnika za pomoc zbog dugog trajanja postupka I neizvrsenih presuda iz lose privatizovanih firmi, kojima nisu isplacene plate I porezi I doprinosi po pravnosnaznim I izvrsnim presudama.

Takodje veliki broj korisnika se zalio na neefikasnu sudsku zastitu zbog krsenja prava na pravicno sudjenje pred nepristrasnim I nezavisnim sudom.

Imajuci u vidu da jug Srbije I grad Leskovac spada u kategoriju najsiromasnijih mesta u Srbiji, gde po najnovijim statistikama ima preko 40.000 nezaposljenih , sto je nasledjeno stanje, u gradu zivi 10 000 – 12 000 roma od kojih nemamo prituzbe na diskriminaciju vec na siromastvo, nezaposljenost I lose uslove zivljenja.

U izvestajnom periodu nemamo prituzbe na rad gradskih vlasti osim prituzbe na rad gradske uprave za inspekcijske poslove.

Takodje u toku 2014.godine grad je iz budzetske linije 481 finansijski pomagao udruzenja I druge vrste organizacija sto se nastavlja I u 2015.godini.

Saradnja Odbora za ljudska prava sa gradskim vlastima je na zadovoljavajucem nivou, takodje sa policijom I drugim javnim institucijama.

ANNUAL REPORT OF THE COMMITTEE FOR HUMAN RIGHTS IN LESKOVAC ABOUT THE CURRENT STATE OF HUMAN RIGHTS ON THE TERRITORY OF JABLANICA AND PCINJA DISTRICT IN RELATION TO THE DECLARATION OF THE UN GENERAL ASSEMBLY OF HUMAN RIGHTS AND THE WORK OF THE COMMITTEE DIRECTED TOWARDS THE AFFIRMATION AND PROTECTION

During the reporting year,  3,811 users asked the Committee for Human Rights Leskovac for legal help and advice.  Majority, 3, 800 users of our services came to our office personally while the remaining users contacted us by phone, e-mail or letter.

Most of the users are Serbian nationality, but there were a few Roma, Albanian and 4 Arab nationalities.

We provided legal advise from the Committee’s field to 2,986 users.

From the aspect of UN Declaration we were asked for help in the following:

Article 13, the right to life, freedom and personal safety – 183 cases

Article 1, the right to respect of human dignity – 105 cases

Article 5, ban on torture, cruel or inhuman or humiliating actions or punishment of people – 29 cases

Article 6, the right to legal subjectivity – 355 cases

Article 7,  the right to equal law protection without discrimination – 122 cases

Article 8, the right to efficient court protection from the violation of human rights as recognized by the Constitution and law, 359 cases

Article 9, ban on arbitrarily arrest and confinement – 12 cases

Article 10, the right to objective trial before an  independent and impartial court – 330 cases

Article 12, ban on arbitrarily interference into personal life, family, apartment, correspondence and attack on honour and respect – 71 case

Article 13, the right to freedom of movement – 29 cases

Article 17, the right to property and ban on arbitrarily deprivation of property – 105 cases

Article 19, the right to freedom of opinion and expressing opinion – 14 cases

Article 20, the right to peaceful assembly  and association – 5 cases

Article 21, The right to participate and take part in public service and the right of an individual to equally access public service in their country – 13 cases

Article 23. the right to work and have satisfying working conditions – 1,593 cases

Article 24, the right to have a rest and holiday – 18 cases

Article 25, the right to satisfying standard of living and the right to housing – 463 cases

Article 26, the right to education – 5 cases

Within the reporting period, for the needs of our users, we wrote 133 complaints, 81 appeals, 205 criminal charges, 156 complaints according to article 34 of the Charter on human and minority rights of the Republic of Serbia and article 48 of the Constitution of the Republic of Serbia for non-functioning and inefficient working of courts, 350 requests to Working inspection, 155 petition of various kinds, 61 suggestions for repetition of misdemeanor and criminal proceedings, 3 requests for conducting an investigation and 16 petitions to the International court for human rights in Strasbour.

We received a number of complaints by numerous users, from  badly privatised companies, about the length of proceedings and non-execution of verdicts. The complaints were about not getting pays, taxes and contributions although the verdicts became in effect and enforceable.

Also a vast number of users complained about inefficient court protection because of the violation of the right to a fair trial before an impartial and independent court.

Having in mind the fact that the south of Serbia and the town of Leskovac falls into the category of poorest places in Serbia, with, according to the latest statistics,  over 40,000 unemployed, which is an inherited situation, there are about 10, 000 to 12,000 Roma from whom we did not get complaints about discrimination but against poverty, unemployment and bad living conditions.

During the reporting period we did not get complaints about the work of the town’s authorities expect on the work of the town’s department for inspections.

Also, during 2014, the town, from the budget line 481 financially supported association and other organizations which continues in 2015.

The cooperation of the Committee for Human Rights Leskovac with the town authorities is on a satisfactory level as is with the police and other public institutions.
