GODISNJI IZVESTAJ ODBORA ZA LJUDSKA PRAVA U LESKOVCU O STANJU LJUDSKIH PRAVA NA TERITORIJI JABLANICKOG I DELA PCINJSKOG OKRUGA, SA ASPEKTA DEKLARACIJE GENERALNE SKUPSTINE UN O LJUDSKIM PRAVIMA, I RADU ODBORA NA AFIRMACIJI I ZASTITI TIH PRAVA U 2016 GODINI

U toku 2016 godine Odboru za ljudska prava u Leskovcu za pravnu pomoc i pravne savete obratilo se 3376 ljudi.Od toga 3120 korisnika nasih usluga obratilo nam se licno dolaskom u kancelariju Odbora za koji su culi iz medija, od prijatelja ili korisnika nasih usluga,
Sto se tice nacionalne strukture korisnika nasih usluga najvise je pripadnika Srpske nacionalnosti, zatim jedna grupa pripadnika Bugarske nacionalnosti iz Bosilegrada i Surdulice, pripadnici Romske nacionalnosti iz Leskovca, Surdulice, Vranja i Beograda, tri pripadnika Albanske nacionalnosti od kojih dva iz Leskovca i jedan iz Medvedje i jedan Palestinac. Po prvi put su nam se javila za pravnu pomoc 14 migranata iz Iraka, Sirije i Avganistana
U izvestajnom periodu slucajevi 3221 korisnika po nasoj oceni bili su iz oblasti delatnosti Odbora, 123 korisnika nisu bili iz oblasti rada ovog Odbora.

Pravne savete u slucajevima iz oblasti delatnosti Odbora u izvestajnom periodu trazilo je i dobilo 242 korisnika,
Sto se tice strukture prava, gledano sa aspekta Deklaracije Generalne skupstine Ujedinjenih nacija povodom cijeg krsenja ili ugrozavanja su nam se korisnici u izvestajnom periodu obracali za pomoc i zastitu, ta struktura izgleda na sledeci nacin:

Najveci broj nasih korisnika je trazio pomoc iz radnih odnosa.To su zaostala primanja otpustenih radnika iz propalih firmi Ili lose privatizovanih a koji nemaju sredstva da angazuju advokate.Takodje veliki broj njih ima neuplaceni radni staz ili nepovezan sa njihovim predhodnim radnim angazovanjem. Naime, to su radnici firmi nad kojima su pokrenuti stečajni postupci još pre 7 godina, I koji još uvek traju. Radnici su vodili parnične postupke pred Osnovnim sudom u Leskovcu, ishodovali pravnosnažne I izvršne presude na ime neisplaćenih minimalnih zarada kao I na ime uplate zakonom propisane doprinose , neisplaćenu otpremninu , regres za godišnji odmor, kao I troškove postupka sve sa zakonskom zateznom kamatom. Tuženici nisu dobrovoljno isplaćivali iznose određene presudama, te su radnici pokretali postupke izvršenja. Nad izvršnim dužnikom, tj. Firmama, otvoreni su stečajni postupci, I postupci izvršenja su prekinuti. Izvršni poverioci tj.radnici su prijavili potraživanja u stečajnom postupku, Privredni sud im je priznao I razvrstao u određeni isplatni red, najčešće treći ili četvrti. Evropski sud za ljudska prava u Strazburu zauzeo je stav da potraživanje radnika utvrđeno pravnosnažnom I izvršnom presudom predstavlja njihovu imovinu. Takodje Sud je zauzeo je stav da se postupci izvršenja I postupak stečaja posmatraju jedinstveno. Od 01.01.2016.godine stupio je na snagu Zakon o zaštiti prava na suđenje u razumnom roku. U skladu sa svim napred navedenim, napisali smo veliki broj Prigovora za ubrzavanje postupka, tužbi za naknadu nematerijalne štete , Ustavnih žalbi zbog povrede Ustavom zagarantovanih prava, kao I predstavke Evropskom sudu za ljudska prava u Strazburu zbog povrede Konvencije za zaštitu ljudskih prava I osnovnih sloboda I predviđenim Protokolima.

Iavilo nam se I desetine korisnika koji ne mogu da naplate svoja potrazivanja od strane pojedinih advokata.Naime drzava je po odluci Medjunarodnog suda iz Strazbura uplatila sredstva po odluci suda na racun advokata, ali neki advokati ta uplacena sredstva ne isplacuju svojim klijentima vec ih drze na svojim racunima I kako,kazu nasi klijenti nemaju nameru ni da im uplate jer to traje vise od godinu dana. Mi smo sa takvim stanjem obevestili Ministarstvo pravde.
Imali smo I nekoliko slucajeva prebijanja mladjih ljudi od strane nepoznatih pocinilaca koji pripadaju LGBT zajednici.Na nas savet oni su se organizovali u jednu odrzivu grupu I kako nemaju gde da se sastaju mi smo im omogucili sastanke u nasim prostorijama gde razgovaraju o svojim problemima.
Nema incidenata sa romskom populacijom koja je u nasem gradu velika ,sem problema sa zaposljavanjem ali to je problem I vecinskog srpskog stanovnistva. Lokalna vlast je uspela da smanji procenat nezaposljenosti ali to jos uvek nije dovoljno.
Vec trecu godinu nemamo prutuzbe na rad lokalnih organa vlasti I imamo samo reci hvale na rad gradonacelnika I njegovog kabineta. Ima sporadicnih zalbi na rad pojedinaca iz gradjevinske inspekcija,ali to smo prosledili Repubickim organima.
Ono sto zabrinjava je pojava migranata na ovoj balkanskoj ruti,gde pojedini prevoznici ilegalno prevoze migrante I kada im naplate prevoz ostavljaju ih duz auto puta Skoplje- Nis
I to u delu Grdelicke klisure I blize Leskovcu.

AN ANNUAL REPORT OF THE COMMITTEE FOR HUMAN RIGHTS IN LESKOVAC ON THE STATE OF HUMAN RIGHTS ON THE TERRITORY OF JABLANICA DISTRICT AND PART OF PCINJA DISTRICT, FROM THE ASPECT OF UN GENERAL ASSEMBLY DECLARATION ON HUMAN RIGHTS, AND THE COMMITTEE’S WORK ON THE AFFIRMATION AND PROTECTION OF THOSE RIGHTS IN 2016.

In the course of 2016, to the Committee for Human Rights in Leskovac, 3376 people approached for legal assistance and legal advice. Of those, 3120 users of our services contacted us personally in our office of the Committee, for which they heard from the media, or from their friends or from other users of our services.
Regarding the national structure of the users of our services, most members are of Serbian nationality, followed by a group of users of Bulgarian nationality from Bosilegrad and Surdulica, then members of Roma nationality from Leskovac, Surdulica, Vranje and Belgrade, three users of Albanian nationality of which two are from Leskovac and one from Medvedja, and one Palestinian. For the first time, 14 migrants from Iraq, Syria and Afghanistan approached to us for legal aid.
In the reporting period, 3221 cases of users were, based on our assessment, in the Committee’s field of expertise, 123 users were not in the field of this Committee.
In the reporting period, 242 users has sought and received legal advice in cases from the Committee’s field.
As for the structure of the rights, viewed from the point of the Declaration of the United Nations General Assembly, our users have sought help and protection because of its violation or threatening, that structure looks as following:
– Article 1 of the Declaration, the right to human dignity,
– Article 3 of the Declaration, the right to life, liberty and security of person,
– Article 5 of the Declaration, no one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment,
– Article 6 of the Declaration, the right to recognition everywhere as a person before the law,
– Article 7 of the Declaration, the right to equal protection of the law without any discrimination,
– Article 8 of the Declaration, the right to an effective remedy by the competent national tribunals for acts violating the fundamental rights granted him by the constitution or by law,
– Article 9 of the Declaration, no one shall be subjected to arbitrary arrest, detention or exile,
– Article 10 of the Declaration, everyone is entitled in full equality to a fair and public hearing by an independent and impartial tribunal,
– Article 12 of the Declaration, no one shall be subjected to arbitrary interference with his privacy, family, home or correspondence, nor to attack upon his honor and reputation,
– Article 13 of the Declaration, the right to freedom of movement
– Article 17 of the Declaration, the right to own property and no one shall be arbitrarily deprived of his property,
– Article 19 of the Declaration, the right to freedom of opinion and expression,
– Article 20 of the Declaration, the right to freedom of peaceful assembly and association,
– Article 21 of the Declaration, the right to take part in the government of his country and the right of equal access to public service in his country,
– Article 23 of the Declaration, the right to work and to just and favorable conditions of work,
– Article 24 of the Declaration, the right to rest,
– Article 25 of the Declaration, the right to a standard of adequate living and housing,
– Article 26 of the Declaration, the right to education.

Most of our users asked for help related to work. Those are residual incomes of the laid-off workers of bankrupt companies or poorly privatized and who do not have the means to hire lawyers. Also, many of them have unpaid employment status or are unrelated to their previous employment. Namely, those are the workers of the companies on which bankruptcy proceedings were initiated 7 years ago, and which are still ongoing. Workers have initiated civil proceedings before the Municipal court in Leskovac, they brokered final and enforceable judgment for unpaid minimum wages as well as payments of the statutory contributions, unpaid severance pay, the regress for annual leave, as well as all the costs of the proceeding with the statutory default interest. Defendants have not voluntarily paid the amount determined by the judgment, so the workers had to initiate enforcement proceedings. Bankruptcy proceedings were launched against the judgment debtor, i.e. Companies, so the enforcement proceedings were discontinued. Executive creditors, i.e. workers, have filed claims in the bankruptcy proceeding and the Commercial court had acknowledged and sorted it into a certain payout order, usually the third or fourth. The European Court of Human Rights in Strasbourg assumed an attitude that workers’ claims determined by a final and enforceable judgment constitute their property. Also, the Court assumed an attitude that the enforcement proceedings and bankruptcy proceedings are uniquely observed. From January 01, 2016, the Law on the protection of the right to trial came into effect within a reasonable timeframe. According to all mentioned above, we wrote a large number of Complaints for accelerating proceedings, lawsuits for non-pecuniary damage, the Constitutional complaints for the violation of Constitutionally guaranteed rights, as well as the petitions to European Court of Human Rights in Strasbourg for violation of the Convention for the protection of human rights and fundamental freedoms as amended by Protocols.
Dozens of users came to us who cannot collect their claims from certain lawyers. Namely, the country, according to the decision of the International Court in Strasbourg, paid the funds by court decision to lawyers’ accounts, but some lawyers did not pay to their clients these deposited funds, but kept them on their account and, as our clients say, had no intention to pay because it has lasted for over a year and it is still ongoing. We have informed the Ministry of justice about this situation. We have had several cases where young people, who belong to the LGBT community, have been beaten by unknown perpetrators. On our advice, they organized themselves into a viable group, and because they had no place to meet, we allowed them to have meetings in our rooms where they can talk about their problems.
There were no incidents with Roma population, which is large in our city, except a problem with employment, but that is also a problem for the Serbian population, which is the majority in the city. The local government has managed to reduce the percentage of unemployment but it is still not enough.
For the third year, we have had no complaint about the work of local authorities and we had only words of praise on the work of the Mayor and his cabinet. There are sporadic complaints on the work of individuals from the Department of Building Inspection, but we forwarded them to the Republic authorities.
The thing that worries us is the appearance of migrants on this Balkan route, where certain transporters have been illegally transporting migrants, and after charging them the transport, they leave them along the highway Skopje-Nis near the Grdelica Gorge and Leskovac.

GODISNJI IZVESTAJ ODBORA ZA LJUDSKA PRAVA U LESKOVCU O STANJU LJUDSKIH PRAVA NA TERITORIJI GRADA LESKOVCA I JABLANICKOG OKRUGA,SA ASPEKTA DEKLARACIJE GENERALNE SKUPSTINE UN O LJUDSKIM PRAVIMA I RADU ODBORA NA AFIRMACIJI I ZASTITI TIH PRAVA U 2015.GODINI.

U toku 2015.godine Odboru se za pravnu pomoc I pravne savete obratilo 3990 korisnika , dolaskom u nase prostorije, telefonom ili putem elektronske poste.

Nacionalna struktura korisnika je najvecim delom srpske nacionalnosti, albanske, romske I dva arapske nacionalnosti. Pravne savete iz nase delatnosti pruzili smo za 3331 nasih korisnika.

Najveci broj trazioca pravne pomoci, ili njih 2781, su iz clana 23 Deklaracije UN a tice se prava na rad I zadovoljavajuce uslove rada.

Iz clana 5 Deklaracije UN o zabrani mucenja, svirepog ili necovecnog I ponizavajuceg postupanja I kaznjavanja imali smo 31 slucaj,I svi su slucajevi sa teritorije republike Srbije a samo 2 iz naseg okruga.

Iz clana 10 Deklaracije, pravo na pravicno sudjenje u razumnom roku, bilo je 131 slucajeva.

Iz clana 17 Deklaracije, pravo na imovinu I zabrana samovoljnog lisenja imovine, bilo je 58 slucajeva.

Iz clana 7 Deklaracije, pravo na pravicno sudjenje pred nezavisnim I nepristrasnim sudom, bilo je 186 slucajeva.

Iz clana 3 Deklaracije, pravo na zivot,slobodu I licnu bezbednost, bilo je 33 slucaja.

Iz clana 1 Deklaracije, pravo na postovanje ljudskog dostojanstva, bilo je 111 slucaja.

Dali smo preko 3000 pravnih saveta I upustava za postupanja pred sudovima na teritoriji Repubilke Srbije koji ne ulaze u ovu evidenciju, zbog prevelikog broja korisnika a malog broja nasih saradnika.

U okviru izvestajnog perioda I broja korisnika napisali smo 72 tuzbe raznim sudovima, 125 zalbi na razne odluke sudova, 51 Prituzbu po clanu 34 Povelje o ljudskim I manjinskim pravima Republike Srbije, iz clana 48 Ustava RS na nerad I neefikasan rad sudova 31 zalbu, 244 podnesaka raznih vrsta, 55 predloga na ponavljanje prekrsajnih I krivicnih postupaka, 5 zahteva za sprovodjenje istraga I 9 predstavki Medjunarodnom sudu za ljudska prava u Strazburu.

U izvestajnom period nemamo nijednu prituzbu na rad gradskih vlasti I njihovih tela ali ima 23 prituzbe na rad Republickih inspekcijskih organa.

U izvestajnom periodu grad je iz budzetske linije 481 pomogao rad Odbora sa tendencijom pruzanja pomoci I u narednom periodu.

Saradnja Odbora sa rukovodstvom grada je na zadovoljavajucem nivou I postoji visok stepen razumevanja na obostrano zadovoljstvo.

COMMITTEE FOR HUMAN RIGHTS – LESKOVAC’S ANNUAL REPORT ON THE CONDITION OF HUMAN RIGHTS ON THE TERRITORY OF THE TOWN OF LESKOVAC AND JABLANICA DISTRICT FROM THE ASPECT OF UN GENERAL ASSEMBLY DECLARATION ON HUMAN RIGHTS AND THE WORK OF THE COMMITTEE ON THE AFFIRMATION AND PROTECTION OF THESE RIGHTS IN 2015

3,990 users asked the Committee for human rights for legal help and advice, by coming to our office, over the phone or via email.

The national structure of the users very mainly of Serbian nationality, Albanian, Roma and two Arabs. We gave legal advice from our field of interest to 3,331 user.

The biggest number of those who asked legal help, that is 2,781, were from the article 23 of the UN Declaration, that is the right to work and have satisfying working conditions.

From the article 5, of the UN Declaration on banning torture and other cruel and inhuman and humiliating actions and punishments, we had 31 case and all the cases were from the territory of Serbia and two from our district.

From the article 10 of the UN Declaration, the right to a fair trial within reasonable time, there were 131 case.

From the article 17 of the UN Declaration, the right t property and banning of arbitrary deprivation of property, there were 58 cases.

From the article 7 of the UN Declaration, the right to a fair trial before an impartial and independent court, there were 186 cases.

From the article 3 of the UN Declaration, the right to life, freedom and personal safety, there were 33 cases.

From the article 1 of the UN Declaration, the right to respect for human dignity, there were 111 cases.

We gave over 3,000 legal advice and instructions for acting before courts on the territory of Serbia which are not part of this list, due t a large number of users and a small number of associates.

Within the reporting period and the number of users we wrote 72 lawsuits to different courts, 125 complaints to various court decisions, 51 petition according to the article 34 of the Charter on human rights and minority rights of the Republic of Serbia, from the article 48 of the Republic of Serbia Constitution against the nonworking and inefficiency of courts – 31 complaint, 244 various petitions, 55 propositions for repeating misdemeanor and criminal proceedings, 5 motions for investigations and 9 petitions to the International court on Human Rights in Strasbur.

Within the reproting period we did not receive any complaints against the local authorities apart from the complaints against the Repblic Inspection .

During the reporting period, the town of Leskovac, from the 481 budget line supported the work of the Committee and there is a tendency of further support in the upcoming period.

The cooperation with the leadership of the town is on a satisfactory level and there is a high degree of mutual understanding.

GODISNJI IZVESTAJ ODBORA ZA LJUDSKA PRAVA U LESKOVCU O STANJU LJUDSKIH PRAVA NA TERITORIJI JABLANICKOG OKRUGA SA ASPEKTA DEKLARACIJE GENERALNE SKUPSTINE UN O LJUDSKIM PRAVIMA I RADU ODBORA NA AFIRMACIJI I ZASTITI TIH PRAVA U 2014 GODINI.

Tokom 2014.godine Odboru za ljudska prava u Leskovcu za pravnu pomoc I pravne savete obratila su se 3811 korisnika,od tog broja oko 3000 korisnika nasih usluga obratilo nam se licno,dolaskom u kancelariju Odbora dok se preostali broj korisnika javio telefonom,mejlom ili pismom.

Nacinalna struktura korisnika je najvecim delom srpske nacionalnosti,zatim romske,albanske I cetiri arapske nacionalnosti.

Pravne savete iz delatnosti Odbora pruzili smo za 2986 nasih korisnika.

Sa aspekta Deklaracije Generalne Skupstine Ujedinjenih Nacija korisnici koji su nam se obracali za pomoc je sledeca:

U izvestajnom periodu za potrebe korisnika nasih usluga napisali smo 133 tuzbe, 81 zalbu, 205 krivicne prijave, 156 Prituzbe po cl.34 Povelje o ljudskim I manjinskim pravima Republike Srbije I cl.48 Ustava Republike Srbije, na nerad I neefikasan rad sudova, 350 zahteva inspekciji rada, 155 podnesaka razne vrste, 61 predlog za ponavljanje prekrsajnih I krivicnih postupaka, 3 zahteva za sprovodjenje istrage, 16 predstavke Medjunarodnom sudu za ljudska prava u Strazburu.

U izvestajnom periodu nam se javio najveci broj korisnika za pomoc zbog dugog trajanja postupka I neizvrsenih presuda iz lose privatizovanih firmi, kojima nisu isplacene plate I porezi I doprinosi po pravnosnaznim I izvrsnim presudama.

Takodje veliki broj korisnika se zalio na neefikasnu sudsku zastitu zbog krsenja prava na pravicno sudjenje pred nepristrasnim I nezavisnim sudom.

Imajuci u vidu da jug Srbije I grad Leskovac spada u kategoriju najsiromasnijih mesta u Srbiji, gde po najnovijim statistikama ima preko 40.000 nezaposljenih , sto je nasledjeno stanje, u gradu zivi 10 000 – 12 000 roma od kojih nemamo prituzbe na diskriminaciju vec na siromastvo, nezaposljenost I lose uslove zivljenja.

U izvestajnom periodu nemamo prituzbe na rad gradskih vlasti osim prituzbe na rad gradske uprave za inspekcijske poslove.

Takodje u toku 2014.godine grad je iz budzetske linije 481 finansijski pomagao udruzenja I druge vrste organizacija sto se nastavlja I u 2015.godini.

Saradnja Odbora za ljudska prava sa gradskim vlastima je na zadovoljavajucem nivou, takodje sa policijom I drugim javnim institucijama.

ANNUAL REPORT OF THE COMMITTEE FOR HUMAN RIGHTS IN LESKOVAC ABOUT THE CURRENT STATE OF HUMAN RIGHTS ON THE TERRITORY OF JABLANICA AND PCINJA DISTRICT IN RELATION TO THE DECLARATION OF THE UN GENERAL ASSEMBLY OF HUMAN RIGHTS AND THE WORK OF THE COMMITTEE DIRECTED TOWARDS THE AFFIRMATION AND PROTECTION

During the reporting year,  3,811 users asked the Committee for Human Rights Leskovac for legal help and advice.  Majority, 3, 800 users of our services came to our office personally while the remaining users contacted us by phone, e-mail or letter.

Most of the users are Serbian nationality, but there were a few Roma, Albanian and 4 Arab nationalities.

We provided legal advise from the Committee’s field to 2,986 users.

From the aspect of UN Declaration we were asked for help in the following:

Article 13, the right to life, freedom and personal safety – 183 cases

Article 1, the right to respect of human dignity – 105 cases

Article 5, ban on torture, cruel or inhuman or humiliating actions or punishment of people – 29 cases

Article 6, the right to legal subjectivity – 355 cases

Article 7,  the right to equal law protection without discrimination – 122 cases

Article 8, the right to efficient court protection from the violation of human rights as recognized by the Constitution and law, 359 cases

Article 9, ban on arbitrarily arrest and confinement – 12 cases

Article 10, the right to objective trial before an  independent and impartial court – 330 cases

Article 12, ban on arbitrarily interference into personal life, family, apartment, correspondence and attack on honour and respect – 71 case

Article 13, the right to freedom of movement – 29 cases

Article 17, the right to property and ban on arbitrarily deprivation of property – 105 cases

Article 19, the right to freedom of opinion and expressing opinion – 14 cases

Article 20, the right to peaceful assembly  and association – 5 cases

Article 21, The right to participate and take part in public service and the right of an individual to equally access public service in their country – 13 cases

Article 23. the right to work and have satisfying working conditions – 1,593 cases

Article 24, the right to have a rest and holiday – 18 cases

Article 25, the right to satisfying standard of living and the right to housing – 463 cases

Article 26, the right to education – 5 cases

Within the reporting period, for the needs of our users, we wrote 133 complaints, 81 appeals, 205 criminal charges, 156 complaints according to article 34 of the Charter on human and minority rights of the Republic of Serbia and article 48 of the Constitution of the Republic of Serbia for non-functioning and inefficient working of courts, 350 requests to Working inspection, 155 petition of various kinds, 61 suggestions for repetition of misdemeanor and criminal proceedings, 3 requests for conducting an investigation and 16 petitions to the International court for human rights in Strasbour.

We received a number of complaints by numerous users, from  badly privatised companies, about the length of proceedings and non-execution of verdicts. The complaints were about not getting pays, taxes and contributions although the verdicts became in effect and enforceable.

Also a vast number of users complained about inefficient court protection because of the violation of the right to a fair trial before an impartial and independent court.

Having in mind the fact that the south of Serbia and the town of Leskovac falls into the category of poorest places in Serbia, with, according to the latest statistics,  over 40,000 unemployed, which is an inherited situation, there are about 10, 000 to 12,000 Roma from whom we did not get complaints about discrimination but against poverty, unemployment and bad living conditions.

During the reporting period we did not get complaints about the work of the town’s authorities expect on the work of the town’s department for inspections.

Also, during 2014, the town, from the budget line 481 financially supported association and other organizations which continues in 2015.

The cooperation of the Committee for Human Rights Leskovac with the town authorities is on a satisfactory level as is with the police and other public institutions.
