GODISNJI IZVESTAJ ODBORA ZA LJUDSKA PRAVA U LESKOVCU O STANJU LJUDSKIH PRAVA NA TERITORIJI JABLANICKOG I DELA PCINJSKOG OKRUGA, SA ASPEKTA DEKLARACIJE GENERALNE SKUPSTINE UN O LJUDSKIM PRAVIMA, I RADU ODBORA NA AFIRMACIJI I ZASTITI TIH PRAVA U 2017GODINI

                   U toku 2017godine Odboru za ljudska prava u Leskovcu za pravnu pomoc i pravne savete obratilo se 2376 ljudi, u proseku preko 76 mesecno.Od togvecina njih obratilo nam se licno dolaskom u kancelariju Odbora za koji su culi iz medija, od prijatelja ili korisnika nasih usluga, 11 korisnika  obratilo se telefonom, a 12 korisnika pismenim putem

                   Sto se tice nacionalne strukture korisnika nasih usluga najvise je pripadnika Srpske nacionalnosti, zatim jedna grupa pripadnika Bugarske nacionalnosti iz Bosilegrada i Surdulice, pripadnici Romske nacionalnosti iz Leskovca, Surdulice, Vranja i Beograda, tri pripadnika Albanske nacionalnosti od kojih dva iz Leskovca i jedan iz Medvedje i jedan Palestinac.

                   U izvestajnom periodu slucajevi 1253 korisnika po nasoj oceni bili su iz oblasti delatnosti Odbora,

                   korisnika, a pravnu pomoc koja nije iz oblasti rada Odbora trazilo je 112 korisnika.

                   Pravne savete u slucajevima iz oblasti delatnosti Odbora u izvestajnom periodu trazilo je i dobilo 1242 korisnika, a pravne savete u slucajevima koji nisu iz oblasti delatnosti Odbora u izvestajnom periodu trazilo je i dobilo 94 korisnika.                

                   Sto se tice strukture prava, gledano sa aspekta Deklaracije Generalne skupstine Ujedinjenih nacija povodom cijeg krsenja ili ugrozavanja su nam se korisnici u izvestajnom periodu obracali za pomoc i zastitu, ta struktura izgleda na sledeci nacin:

-cl.1 Deklaracije, pravo na postovanje ljudskog dostojanstva

-cl.3 Deklaracije, pravo na zivot slobodu i licnu bezbednost, –

-cl.5 Deklaracije, zabrana mucenja svirepog ili necovecnog ili ponizavajuceg postupanja ili kaznjavanja ljudi,

-cl.6 Deklaracije, – pravo na pravni subjektivitet

-cl.7 Deklaracije, pravo na jednaku zastitu zakona bez diskriminacije-

-cl.8 Deklaracije, pravo na efikasnu sudsku zastitu od dela krsenja osnovnih prava priznatih ustavom i zakonom

-cl.9 Deklaracije, zabrana proizvoljnog hapsenja i pritvaranja

-cl.10 Deklaracije, pravo na pravicno sudjenje pred nezavisnim i nepristrasnim sudom

-cl.12 Deklaracije, zabrana proizvoljnog mesanja u privatni zivot, porodicu stan prepisku i napadima na cast i ugled

-cl.13 Deklaracije, pravo na slobodu kretanja

-cl.17 Deklaracije, pravo na imovinu i zabrane samovoljnog lisenja imovine

-cl.19 Deklaracije, pravo na slobodu misljenja i izrazavanja misljenja

                   U izvestajnom periodu za potrebe korisnika nasih usluga napisali smo 58 tuzbe, 19 zalbe, 51 krivicne prijave, 82 Prituzbe po cl.34 Povelje o ljudskim i manjinskim pravima i gradjanskim slobodama  i cl.48 Ustava Republike Srbije, uglavnom na nerad i neefikasan rad sudova,  321 zahteva Inspekciji rada i Upravnoj inspekciji za odlaganje izvrsenja resenja poslodavaca kojima se krse pravo na rad i prava po osnovu rada, 3 zahteva za priznanje prava na Prigovor savesti, 12 podnesaka razne vrste, 23 predloga za ponavljanje prekrsajnih i krivicnih postupaka, 19 Zahtev za sprovodjenje istrage,

                   U izvestajnom periodu u razmatranje za zastupanje uzeli smo 69 slucajeva, a za zastupanje 58 slucajeva.

                   Iz izvestaja se evidentno vidi da nam se najveci broj korisnika javljao za pomoc i savete zbog krsenja prava na efikasnu sudsku zastitu i prava na pravicno sudjenje pred nezavisnim i nepristrasnim sudom, koja su vezana za rad sudova a manifestovala su se brojnim slucajevima u kojima Opstinski sud u Leskovcu krsenjem odredbe cl.4 Zakona o izvrsnom postupku, mesecima nije odlucivao po predlozima za odredjivanje privremenih mera, iako ga prednja odredba obavezuje na hitno postupanje u takvim slucajevima, protiv jos jednog sudije za krivicno delo Krsenje zakona od strane sudije.U radnim sporovima za koje Zakon o radu u cl.122 st.3, propisuje da moraju biti pravnosnazno zavrseni u roku od sest meseci od dana podnosenja tuzbe,

U Jablanickom okrugu koji je I predmet nase paznje belezimo veci broj primedbi na rad Opstinsko I Viseg suda u Leskovcu I pojedinih sudija na koje gradjani imaju primedbe ne njihov rad.Ovo belezimo jer se veci broj gradjana zalio na iste sudije iz oba suda.

Inace primetan je I animozitet kod pojedinaca na rad jedine nevladine organizacije koja se bavi problemima LGBT osoba u Leskovcu.To nas upucuje na zakljucak da svest gradjana jos nije razvijen do te mere da shvati da su to nasi gradjani ,nase komsije bez obzira na njihovu polnu orijentacije.Nismo zabelezili nijedan slucaj zalbe na rad lokalnog upravnog aparata I da nema zalbi na rad policije u gradu.

Posebno raduje  cinjenica da nije zabelezan nijedan slucaj diskriminacije romskog stanovnistva iako su njihovi problemi najvise vidljivi.

ANNUAL REPORT OF THE HUMAN RIGHTS COMMITTEE IN LESKOVAC ON HUMAN RIGHTS IN THE TERRITORY OF JABLANICA AND A PART OF PCINJA DISTRICT, FROM THE ASPECT OF UN GENERAL ASSEMBLY DECLARATION ON HUMAN RIGHTS AND THE COMMITTEE’S WORK ON AFFIRMATION AND PROTECTION OF THOSE RIGHTS IN 2017

                   During 2017, 2376 people addressed the Committee for Human Rights for legal assistance and legal advice, over 76 a month on average. Most of them addressed us personally by coming to the office of the Committee of which they heard from the media, friends or users of our services, 11 users contacted us by telephone and 12 users by writing

                   As far as the national structure of the users of our services is concerned, the majority of the members is of the Serbian nationality, followed by a group of members of the Bulgarian nationality from Bosilegrad and Surdulica, members of the Roma nationality from Leskovac, Surdulica, Vranje and Beograd, three ethnic Albanians of whom two are from Leskovac and one from Medvedja, and one Palestinian.

                   In the reporting period, the cases of 1253 users, according to our estimate, were from the area of activity of the Committee,

                   and legal aid, which is not in the field work of the Committee, was requested by 112 users.

                   In the reporting period, legal advice in cases from the area of activity of the Committee was requested and received by 1242 users, and legal advice in cases that were not from the area of activity of the Committee was requested and received by 94 users.                  

                   Regarding the law structure, viewed from the aspect of the Declaration of the General Assembly of the United Nations on the occasion of the violation or endangerment, users have addressed us for assistance and protection in the reporting period, this structure looks like the following:

-art. 1 of the Declaration, the right to respect human dignity;

– art. 3 of the Declaration, the right to life, liberty and security of person;

– art. 5 of the Declaration, the prohibition of being subjected to torture or cruel, inhuman or degrading treatment or punishment;

– art. 6 of the Declaration, the right to recognition as a person before the law;

– art. 7 of the Declaration, the right to equal protection of the law without any discrimination;

– art. 8 of the Declaration, the right to an effective remedy by the competent national tribunals for acts violating the fundamental rights granted him by the constitution or by law;

– art. 9 of the Declaration, the prohibition to being subjected to arbitrary arrest, detention or exile;

– art. 10 of the Declaration, the right to a fair and public hearing by an independent and impartial tribunal;

– art. 12 of the Declaration, the prohibition to being subjected to arbitrary interference with his privacy, family, home or correspondence, or to attacks upon his honor and reputation;

– art. 13 of the Declaration, the right to freedom of movement;

– art. 17 of the Declaration, the right to own property and the prohibition to being arbitrarily deprived of owned property;

– art. 19 of the Declaration, the right to freedom of opinion and expression;

– art. 20 of the Declaration, the right to freedom of peaceful assembly and association;

– art. 21 of the Declaration, the right to take part in the government and the right of equal access to public service in his country;

– art. 23 of the Declaration, the right to work and to just and favorable condition of work;

– art. 24 of the Declaration, the right to rest and leisure;

– art. 25 of the Declaration, the right to a standard of living adequate and the right to housing;

– art. 26 of the Declaration, the right to education.

                   In the reporting period, for the needs of the users of our services we wrote 58 lawsuits, 19 appeals, 51 criminal charges, 82 complaints under the Article 34 of the Declaration of Human and Minority Rights and Civil Liberty and the Article 48 of the Constitution of the Republic of Serbia, mainly on the averse and inefficient work of the courts, 321 requests to the Labor Inspectorate and the Administrative Inspection to postpone the execution of the employers’ decisions which violate the right to work and labor rights, 3 requests for the recognition of the right to Conscientious Objection, 12 submissions of various types, 23 proposals for a rerun of penal and infringement procedures, 19 requests for conducting an investigation.

                   In the reporting period, we took 69 cases in consideration for representation, and 58 for representation.

                   It is evident from the report that the largest number of users contacted us for help and advice for the violation of the right to an effective judicial protection and the right to an effective remedy by the independent and impartial tribunal, which are related to the work of the courts and were manifested in numerous cases in which the Municipal Court in Leskovac, by violating the provision of the Article 4 of the Law on Enforcement Procedure, had not decided on the proposals for determination of provisional measures for months, even though the foregoing provision obliges him to take urgent action in such cases, against another judge for a criminal offense Violation of law by a judge. In labor disputes for which the Labor Law in Article 122 paragraph 3 stipulates that they must be legally concluded within six month from the date of the lawsuit,

In the Jablanica District, which is the subject of our attention, we have recorded a larger number of complaints about the work of the Municipal and High Courts in Leskovac and some of the judges on whom citizens have complaints about their work. We record this because a large number of citizens complained on the same judges from both courts.

Anyhow, there has been a notable animosity of some individuals towards the work of one non-governmental organization that deals with the problems of LGBT people in Leskovac. This leads us to the conclusion that the consciousness of the citizens has not yet been developed to that extent when they can realize that they are our citizens, our neighbors, regardless of their sexual orientation. We have not recorded any complaints about the operation of the local administrative apparatus and that there are no complaints about the work of the police in the city.

We are particularly pleased by the fact that no cases of discrimination against the Roma population have been recorded, even though their problems are most visible.
