REQUEST by

The Committee for Human Rights Leskovac, from Leskovac, 37/2 Svetozara Markovica Street, represented by the legal representative, Nesic Dobrosav, from Leskovac

– For access to information of public importance;

– Filed according to the articles 2, 3 and 15 of the Law on free access to information of public importance;

– Number of copies 1;

– No attachments;

– Committee for Human Rights Leskovac kindly asks the Penitentiary Institution in Nis, based on the stipulations of the Law on free access to information of public importance; articles 46 and 51 of the Constitution of Serbia; and article 10 of the EU Convention on human rights protection and basic Freedoms, to issue and send over the mail the copy of the document containing the data about the working of the institution which it must possess, that is:

– A copy of the document containing the legal basis according to which the Penitentiary Institution in Nis, as opposed to the stipulations of articles 76, and 77, paragraph 1 of the Law on Executions of Criminal Sanctions, regulations number 4 and 72, paragraph 1 of the European Prison Rules and article 4, paragraph 2 of the Rulebook on measures for maintaining order and safety in prisons, applies the measure Special security measure – Accommodation under increased supervision from the article 151 of the Law on execution of Criminal Sanctions and articles 30 and 33 of the Rulebook on measures for maintaining safety and security in prisons (Official Gazzette of the Republic of Serbia 105/2014), in the basement rooms of the Special object outside the prison premises from the article 27, paragraph 1 of the Rulebook on measures for maintaining safety and security in prisons, in rooms which are buried in the ground, do not have sufficient light, air and are not airy and do not fit the general standards for premises in which convicted people are accommodated, as prescribed by the regulations of the Law on execution of criminal sanctions, Rulebook on house order in Prisons and regulations of the articles 37, paragraph 5 of the Rulebook on measures for maintaining order, safety and security in prisons, and, in the way which represents inhumane or humiliating proceedings by which human dignity of the convicted people is insulted, if the information is correct about such proceedings towards the emprisoned in this prison.
